Donate embryos to infertile couples is one of the effective methods of treating infertility, which allows couples who are unable to have children for various reasons to have a child. In this method, embryos obtained from the combination of egg and sperm are received from donors and placed in the uterus of an infertile woman. This method is usually recommended for couples who have problems with egg or sperm production or cannot conceive despite using other methods.
The process of donate embryos to infertile couples includes legal and medical procedures that must be done carefully. First, the physical and mental health of donors and recipients are checked. Then, after making the necessary arrangements, the embryo is transferred to the woman’s uterus, and if successful, the pregnancy process begins.
This method can be a new hope for infertile couples and give them the opportunity to experience parenthood.
Article 1 – Pursuant to this law, all competent infertility treatment centers will be allowed to transfer embryos resulting from extrauterine insemination of legal and Islamic couples after the written consent of the couple who owns the fetus to the womb of women who, after marriage and Carrying out medical procedures for their infertility (each alone or both) have been proven.
Article 2 – The request to receive a donated embryo must be prepared jointly by the husband and wife and submitted to the court, and the court will issue a license to receive the embryo if the following conditions are met:
Article 3 – The duties and obligations of the donor couple and the born child in terms of maintenance and education, alimony and respect are similar to the duties and obligations of children and parents.
Article 4 – The examination of the eligibility of the applicant spouses in the family courts will be done out of turn and without observing the formalities of the civil procedure, and the failure to confirm the eligibility of the spouses can be appealed.
Article 5 – The executive regulations of this law will be prepared within three months by the Ministry of Health, Treatment and Medical Education in cooperation with the Ministry of Justice and will be approved by the Cabinet of Ministers.
The above law consisting of five articles was approved by the Islamic Council in a public meeting on Sunday, July 29th, 1382 and was approved by the Guardian Council on 8.5.2013.
The use of donate embryos to infertile couples should be carefully examined not only from a medical point of view, but also from a legal and ethical point of view. In many countries, there are specific rules for the process of donate embryos to infertile couples that both parties, i.e. donors and recipients, must adhere to. These rules include formal consents, preserving the identity of donors and guaranteeing the rights of recipient couples.
